1. Acceptance of Terms

By accessing or using Marksy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including educators, administrators, and any other individuals who access or use Marksy.

2. Description of Service

Marksy is an AI-powered assessment grading assistant designed to help IB educators grade Internal Assessments, Extended Essays, and TOK assignments. The Service provides:

  • AI-powered grading analysis based on IB assessment criteria
  • Criterion-by-criterion feedback and justifications
  • Bulk grading capabilities for multiple submissions
  • Export and record-keeping features

The Service is intended as an educational tool to assist educators. Final grading decisions remain the responsibility of the educator.

3. User Accounts

3.1 Account Creation

To use Marksy, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibility

You are responsible for:

  • All activities that occur under your account
  • Maintaining the security of your account
  • Notifying us immediately of any unauthorized access
  • Ensuring you have the right to upload and process any content you submit

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Upload content that violates any laws, regulations, or third-party rights
  • Upload malicious software, viruses, or harmful code
  • Attempt to gain unauthorized access to the Service or related systems
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to process content without proper authorization
  • Resell or redistribute the Service without our written permission
  • Use automated systems to access the Service in ways that could harm or overload our systems
  • Impersonate any person or entity or misrepresent your affiliation

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you upload to Marksy. By uploading content, you grant us a limited license to:

  • Process and analyze your content to provide grading services
  • Store your content temporarily as necessary to provide the Service
  • Use anonymized, aggregated data to improve our AI models and services

5.2 Our Content

The Service, including its design, features, and functionality, is owned by Marksy and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service.

6. Subscription and Payment

6.1 Subscription Plans

Marksy offers various subscription plans with different features and usage limits. Subscription fees are billed in advance on a recurring basis.

6.2 Payment Terms

By subscribing, you agree to pay all fees associated with your chosen plan. Payments are processed through secure third-party payment processors. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will continue to have access to the Service until the end of the period you have paid for.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues or system failures
  • Circumstances beyond our reasonable control

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be error-free or uninterrupted
  • Warranties regarding the accuracy or reliability of grading results

Marksy is an educational tool designed to assist educators. Grading results are suggestions based on AI analysis and should be reviewed by qualified educators. Final grading decisions are your responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

  • Loss of profits, data, or business opportunities
  • Errors or inaccuracies in grading results
  • Unauthorized access to or use of your data
  • Service interruptions or failures

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Marksy, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you upload or submit

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Any other reason we deem necessary

Upon termination, your right to use the Service will cease immediately. We may delete your account and data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through appropriate legal channels.
